LIMITED WARRANTY, PRODUCT DISCLAIMERS & LIMITATIONS OF LIABILITY 

THE FOLLOWING IS MADE IN LIEU OF ALL WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

This Limited Warranty applies Talaya Tiles and Spacers (collectively, the "Talaya Product").

This Limited Warranty does not apply to 3M® Command® Narrow Picture Hanging Strips included with the Talaya Product.

What is Covered?

Unless otherwise provided by local laws, the Talaya Product is warranted against factory defects in workmanship and materials (the "Limited Warranty") for a period of one year from the date of purchase (the "Warranty Period"), with the exception of any Talaya Product on which serial number or other identifying markings have been removed or made illegible. 

LIMITED REMEDY: During the Warranty Period, Talaya North America LLC ("Talaya"), will, at its sole discretion and upon written notice and provision of proper documentation to Talaya Customer Support at support@talaya.co, as outlined in our Return & Refund Policy, either repair or replace any Talaya Product determined by Talaya, in its sole discretion, to have a factory defect in workmanship or materials. Talaya reserves the right to require the Talaya Product be returned to its facility for evaluation of warranty claims. 

How to Obtain Service

If you believe the Talaya Product may be defective, you may contact Talaya at support@talaya.co.  

Talaya's obligations under the Limited Warranty are conditioned on the owner:

(a) providing written notice and documentation by email at the address above during the Warranty Period with a clear description and detailed photos of the alleged failure;

(b) reviewing and completing a provided Warranty Claim Form;

(c) shipping the product along with the completed Warranty Claim Form, at owner's cost, Freight prepaid and Insurance required to TALAYA PMB241, 701 Tillery St. #12, Austin TX, 78702 for repair or replacement. A copy of proof of purchase must also be included with the shipment to confirm the product has not been transferred to another party from the original purchaser. Maintain the original receipt for future reference.  

HOWEVER, Talaya will have no warranty obligations with respect to a returned Talaya Product, including but not limited to costs of return shipping to owner, if Talaya determines, in its sole discretion after examination of the returned Talaya Product, that this Limited Warranty does not apply to the Talaya Product for any reason.  

NOTE: PO BOXES are not valid return addresses due to carrier restrictions.  Unless otherwise specified herein, Talaya will bear all costs of return shipping to owner.  

What is Not Covered?

LIMITATION OF LIABILITY: 

TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAWS, OTHER THAN EXPRESSLY STATED IN WRITING OTHERWISE, IN NO CASE SHALL TALAYA, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, REPLACEMENT OR REPAIR COSTS OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT
LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE TALAYA PRODUCTS OR THE WEBSITE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF ANY OF THE PRODUCTS, THE 3M® PRODUCTS, OR THE WEBSITE, INCLUDING, BUT NOT LIMITED TO, INJURY TO ANY PERSON OR PROPERTY, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY OF THE PRODUCTS, THE 3M® PRODUCTS, OR THE WEBSITE, EVEN IF ADVISED IN ADVANCE OF THE POSSIBILITY. IN NO EVENT SHALL TALAYA’S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE LIMITED WARRANTY, THE TALAYA PRODUCTS, THE 3M® PRODUCTS, OR THE WEBSITE EXCEED THE AMOUNT ACTUALLY PAID FOR THE PRODUCTS BY THE ORIGINAL PURCHASER.

The inclusion of 3M® Command® Narrow Picture Hanging Strips is a convenience for our customers. It is the sole responsibility of the user to read, understand, and strictly adhere to all instructions, warnings, and limitations provided by 3M Company for the proper use, application, and removal of their Command® Narrow Picture Hanging Strips. FAILURE TO FOLLOW 3M'S INSTRUCTIONS MAY RESULT IN DAMAGE TO SURFACES, PERSONAL INJURY, OR DAMAGE TO THE PRODUCT OR OTHER PROPERTY.

EXCEPT AS EXPRESSLY STATED BY THE LIMITED WARRANTY OR OTHERWISE BY TALAYA, TO THE GREATEST EXTENT ALLOWED BY APPLICABLE LAWS, ALL TALAYA PRODUCTS AND 3M® PRODUCTS ARE PROVIDED 'AS IS', WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
